City police arrest two Saturday for driving while impaired

Officers from the Plymouth Police Department arrested two individuals Saturday for being impaired drivers.

At approximately 3:45 in the morning, Officer Lovely initiated a traffic stop on a vehicle believed to be driven by an impaired driver. The driver, Patrick Leary, 40, of Fifth Road in Plymouth, had an interaction earlier in the night and was known to be under the influence of some substance.

After the investigation was complete, Leary was taken into custody and transported to the Marshall County Jail, where he was lodged for operating while intoxicated as a class C misdemeanor.

He was held on a $1,500 cash bond for about 12 hours before being released on bond.

Officer Fisher with the Plymouth Police Department conducted a traffic stop on a vehicle that had no taillights Saturday night, about 9:15. The vehicle pulled over at the BP gas station located at 423 N. Michigan Street, and he was identified as Seth Demarco, 28, of Bremen.

During the stop, it was determined that Demarco had been drinking, so field sobriety tests were performed, and he failed. DeMarco was then taken for a certified blood draw, which showed his blood alcohol content was .132.

Demarco had a prior OWI and was transported to Marshall County Jail, where he was booked in for Felony OWI prior and OWI endangerment and held on a $1,500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed, and there is only probable cause to believe that a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
