The Indiana Attorney General's Office has filed a lawsuit against Jack and Polly Manges, alleging severe neglect and violations of the Indiana Deceptive Consumer Sales Act and landlord-tenant laws.
The complaint details that the Manges, owners of an apartment complex in Argos, failed to maintain habitable living conditions for their tenants. Key allegations include allowing significant water intrusion and mold growth in multiple units, failing to address structural deficiencies, and neglecting necessary repairs despite repeated complaints from tenants and notices from the Attorney General's office.
The lawsuit highlights the emotional and financial toll on tenants, including chronic illnesses due to mold exposure and unjust charges for damages and rent.
The Attorney General's investigation, prompted by tenant complaints, revealed extensive mold contamination, structural issues, and inadequate responses from the Manges. Inspection reports documented mold in air conditioning units, bathrooms, and common areas, along with water damage from faulty plumbing and roofing. The Manges allegedly ignored demands for remediation, leading to hazardous living conditions. The state seeks restitution for affected tenants, civil penalties, and an injunction to compel the Manges to address the violations and ensure safe living conditions.
A spokesperson for the Indiana Attorney General’s Office stated, “Good-paying tenants need to be protected. Landlords need to understand their responsibilities when it comes to mold infestations and that we are serious when we demand that they remediate it."
