Leobardo E. Gualajara-Garcia of Hamlet was arrested on Tuesday, January 28th, after officers from the Marshall County Sheriff’s Department responded to a single-vehicle accident.
At approximately 10:20 PM, County Police were dispatched to an unknown accident on 7th Road, west of Queen Road. Officer Wozniak arrived on the scene and found a 2009 Honda Civic that had driven off the roadway and through a fence.
Gualajara-Garcia was found to be under the influence of alcohol. Field sobriety testing was completed, and a certified test later showed him to be over two times the legal limit of alcohol. He was transported to the Marshall County Jail, booked in for operating a vehicle with a BAC of .15 or more, and held on a $1,500 cash bond.

They are presumed innocent throughout the proceedings, entitled to be represented by counsel, and entitled to a trial by jury, at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
