A jury trial was held last week in Marshall Superior Court III with Judge Matthew Sarber presiding. The case involved three counts against Nurse Practitioner Daniel D. Tanner with Concierge Medicine of Marshall County.
The case stems from an incident on May 14, 2021, where court documents state that Dan Tanner was charged with three counts. The first of knowingly or intentionally aided, induced, or caused David A. Tanner to commit the Practice of Medicine without a License by permitting a non-licensed individual to evaluate and diagnose a patient. Dan Tanner allowed David Tanner to use his DEA registration number to issue a prescription for a legend drug.

Count II on the same day stated that Daniel D. Tanner, a nursing practitioner, issued an invalid prescription for: Dexamethasone and/or Naproxen, and/or Methocarbamol, a legend drug. While count III against Dan Tanner was on March 4 and May 14, 2021, he knowingly or intentionally aided, induced, or caused David Tanner to commit an offense of Practicing Nursing While License Suspended or Revoked.
The State of Indiana is represented by Georgeanna Teipen and Kyle Sprunger, both Deputy Attorneys General. The Defendant is present in person and represented by counsel, Michael Tuszynski.
After three days of testimony, the jury received instructions and spent about 45 minutes in the jury room before announcing their decision. Shortly after 7 p.m. on Friday, the foreperson read the verdict in open court.
The Jury returned verdicts in this case, finding the defendant Daniel Tanner NOT GUILTY of Count I, Aiding, Inducing, or Causing the Practice of Medicine without License, Level Felony; NOT GUILTY of Count II, Issuing Invalid Prescription for Legend Drug by Practitioner, Level Felony; and NOT GUILTY of Count III, Aiding, Inducing, or Causing the Issuing of an Invalid Prescription for Legend Drug by Practitioner, Level Felony.
