On Tuesday, March 26, at approximately 11:00 PM Marshall County Sheriff’s Department deputies responded to the area of Olive Trail and 13th Road for a possibly impaired driver.
Deputy Blake Bennett located a vehicle sitting stationary in the middle of the intersection at Olive Road and 14B Road with the driver of the vehicle slumped over at the wheel. The driver of the vehicle was identified as 56-year-old Kathy Brady of Culver.
During the Deputy’s investigation, suspected controlled substances were located in the vehicle and Ms. Brady was suspected of being under the influence of a controlled substance.
Kathy Brady was transported to the Plymouth Hospital for a certified chemical test. She was then transported to the Marshall County Jail where she was booked for operating a vehicle while intoxicated – endangering a person, as a class A misdemeanor and possession of a schedule I, II, III, IV, or V controlled substance, as a class A misdemeanor.
Her cash bond was set at $1,500.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
