A driver who appeared to be intoxicated was unable to complete the field sobriety testing and refused a certified chemical test was arrested by County Police.
Tuesday evening, June 4th, at approximately 9:15 Officer Wozniak with the Sheriff’s Department initiated a traffic stop on a gray 2007 Chevrolet HHR near the intersection of North Liberty and East Washington Streets in Plymouth. During the investigation, the driver attempted to exit the vehicle. The officer was able to detain the driver and found him to be under the influence of alcohol.
The driver, 39-year-old Alejandro N. Calix Mencias of Lincolnway East in Plymouth, attempted field sobriety testing but was unable to complete it. After being transported to the Plymouth Hospital he refused a certified chemical test.
A local judge signed a search warrant, and a certified blood test was completed. Calix Mencias’s blood alcohol was over three times the legal limit. He was transported to the Marshall County Jail and processed for operating a vehicle with a BAC of .15 or more and operating a vehicle without ever receiving a driver's license. His cash bond was set at $1,500.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
