On October 17th the Marshall County Democratic Party filed a request for records under Indiana Access to Public Records Act against the Marshall County Council. On October 23rd a response was received via email from the County Council’s Attorney Marcellus Lebbin.
The democrats initiated the request in response to the vote by the County Council on October 10 to file an injunction against County Commissioner Kevin Overmyer. The request asked for the referral from Indiana Attorney General Todd Rokita to hire Attorney Laureen White. They wanted to know in what capacity Attorney White was being used by the County Council and any billable hours that Attorney White was charging the County. They also asked for the 160-page document that Attorney White prepared along with any correspondence between Attorney White and members of the Marshall County Council.
The October 23rd response was a letter from Lebbin, the Council attorney, and only a copy of the memorandum Attorney White sent to the County Council.
On Thursday, November 14th local taxpayer Michelle Livinghouse filed a request for records through the Indiana Access to Public Records Act. She is again asking for information on the referral from Indiana Attorney General Todd Rokita for his referral of Attorney White to the Marshall County Council. Her second request is information on White’s services to the County Council with an MOU and billable hours paid for her services by taxpayers. Livinghouse is also seeking all correspondence between Attorney White and members of the County Council.
Because of the lawsuit filed by the County Council against the Board of Commissioners and Tamarack Solar, Livinghouse asked if Attorney Michael Roose, the attorney who filed the lawsuit, was hired in an open meeting. She also asked if there is an agreement for his billable hours and what the cost to the Marshall County Taxpayers is.
