Corporal Schieber with the Plymouth Police Department stopped a vehicle for a moving and licensing violation near the Northgate Mobil Home Park entrance on Saturday, April 26th, about 8:20 p.m. During the traffic stop, the driver was identified as 37-year-old Wayne L. Upchurch Jr of the trailer park in Plymouth.
Plymouth’s K9 Castor assisted at the traffic stop and indicated the presence of narcotics. A loaded firearm was removed from Upchurch's person, and approximately 33 grams of suspected methamphetamine were found in the vehicle.
Upchurch was taken into custody and lodged at the Marshall County Jail. A probable cause affidavit was submitted before the courts and signed by a Marshall County Judge, who assigned a $50,000 bond after finding probable cause for two counts of dealing methamphetamine as a level 2 felony, maintaining a common nuisance as a level 6 felony, and possession of paraphernalia as a class C misdemeanor.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
