Marshall County Deputies were called to the area of 2A Road and Tamarack for a possible impaired driver on Sunday at about 8:20 p.m.
Deputies arrived and located a dark-colored Honda stopped at 2A Road and Tamarack. It was found that the driver, Ma Lay of East Lincoln Street in Bremen, had been drinking. He was offered a certified test, and he consented.
The result of the certified blood test found Lay to be over three times the legal limit.
He was taken to the Marshall County Jail for driving a vehicle while intoxicated and charged with a felony for having a prior conviction and held on a $1,500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings, entitled to be represented by counsel, and entitled to a trial by jury, at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
