Officer Fase with the Plymouth Police Department was dispatched to the Speedway Gas Station at 5:47 Thursday morning for the report of a male subject who appeared to be intoxicated and was causing a scene.

The officer began an investigation, and afterwards took John Albano, 58 of Plymouth, into custody.

Albano was found to have a blood alcohol content of .280. He was transported to the Marshall County Jail and booked on charges of public intoxication and operating a vehicle while intoxicated.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
