Busy Wednesday night for Plymouth Police: OWI, drug arrest, and assault near Simon Street

Plymouth Police officers dealt with a reckless driver, a drug arrest involving a K-9, and a serious assault within hours of each other on Wednesday, June 17th.

Wednesday afternoon, Plymouth Police received a call reporting an impaired driver who was unable to maintain their lane and was driving recklessly. Patrolman Thornton located the vehicle and conducted a traffic stop near the intersection of U.S. 30 and Plymouth Goshen Trail. The officer observed multiple signs of impairment and detected a strong odor of alcohol coming from the vehicle.

The driver, Michael Eric Noskowicz, 44, of Bitter Root Drive in Plymouth, was taken into custody and transported to the Marshall County Jail. He was charged with operating a vehicle while intoxicated endangerment, operating a vehicle while intoxicated with a prior conviction, and operating with a blood alcohol content of .15 or greater.

At 9:41 p.m. Wednesday, Officer Fisher stopped a vehicle traveling west on Markley Drive that was operating without taillights. The vehicle slowly came to a stop on Zentis Drive south of Markley Drive.

The driver, Joseph Herron, 28, of South Bend, raised the officer's suspicions immediately — acting nervously, handing over his car keys unprompted, and opening his car door for no apparent reason. The officer detected an odor of marijuana from the vehicle and called K-9 Officer Schieber and his partner Kyzer to the scene.

When asked if there were drugs in the vehicle, Herron's demeanor shifted noticeably, and he handed the officer a THC vape. Herron was detained, and K-9 Kyzer conducted a free-air sniff, alerting on the vehicle. A search turned up several THC vapes and marijuana, including marijuana found inside a Burger King cup with liquid in it, which Herron attempted to destroy.

Herron was placed under arrest for possession of marijuana and felony obstruction. He was held on a $1,500 cash bond.

Shortly before midnight at 11:35 p.m. On Wednesday, Plymouth Police responded to a fight in progress near 406 Simon Street. Arriving officers discovered a female victim lying unconscious in an alley. The suspect, 19-year-old Danna Aguilar Pineda of West Garro Street in Plymouth, had fled the scene.

Officers contacted Pineda, and she returned to the area shortly after. She was taken into custody, transported to the Marshall County Jail, and booked for battery resulting in serious bodily injury. Pineda was held on a $1,500 cash bond.

 

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
