A Plymouth man was arrested Monday evening after returning to a residence he had been trespassed from and fighting with the officer who tried to take him into custody.
On Monday, September 28th, at approximately 8:30 p.m., Officer Fisher with the Plymouth Police Department was flagged down and advised that a male — identified as 59-year-old Tony Eytcheson — who had previously been trespassed from 223 West Adams Street, was currently at that residence. Witnesses told the officer Eytcheson was walking around the house and appeared to be trying to get inside.
When Officer Fisher arrived, he located Eytcheson coming off the front porch and walking away from officers. The officer stopped Eytcheson and confirmed his information with dispatch. As Officer Fisher attempted to take him into custody, Eytcheson began fighting the officer and resisting.
Eytcheson, of North Walnut Street in Plymouth, was eventually taken into custody after being tased. He was transported to the hospital for medical clearance and then to the Marshall County Jail, where he was booked for resisting law enforcement, public intoxication on drugs, criminal trespass, and battery on law enforcement.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
