City police officers arrested a 64-year-old man for criminal trespass on Wednesday, November 20th.

At approximately 6:15 p.m., officers with the Plymouth Police Department were dispatched to 309 Gibson Street, The Pointe Apartments, for a male party sneaking into the building and living inside.

Officer Fisher arrived on the scene and found a male subject living in room 13.  He was identified as Allan Toomey, 64, with an address of the Pointe Appartements in Plymouth.

The officer’s report indicates that Toomey has been told not to be in Pointe Apartments and was aware he could not stay there.

Allan Toomey was arrested for criminal trespassing, transported to the Marshall County Jail, and held on a $500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
