Officers from the Marshall County Sheriff’s Department investigated a two-vehicle crash with injuries on Friday evening, September 26th, at 7 p.m.
The Marshall County Central Dispatch Center reported a two-vehicle person injury accident on U.S. 30 near Fir Road. Bourbon Fire/EMS, Bourbon Police, and Marshall County Officers responded.
During the crash investigation, Officers discovered that the driver of one of the vehicles was exhibiting signs of alcohol intoxication. 77-year-old Marc Witwer of E. Plymouth Street in Bremen was transported to the Marshall County Jail for operating a motor vehicle with a BAC of .15% or more and operating a motor vehicle while intoxicated, endangering. He was held on a $1,500 cash bond and released about 11:30 a.m. on Saturday after posting bond.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed, and there is only probable cause to believe that a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
