Plymouth Police made two alcohol-related arrests over the weekend, one involving a heavily intoxicated man found bleeding from the face inside a downtown business and the other a Bourbon driver caught speeding through a construction zone with a blood alcohol content nearly three times the legal limit.
On Thursday, August 14th, Plymouth Police were dispatched to Papa John's on North Michigan Street following a report of a male inside the store bleeding from his face. The individual was identified as Matthew O'Brien, 33, of the 500 block of South Michigan Street in Plymouth.
As officers arrived, O'Brien was found in front of another business bothering customers. He was heavily intoxicated and was not cooperative with police regarding how he received his injuries. O'Brien was taken for medical treatment and then lodged in the Marshall County Jail for public intoxication.
The second arrest came Sunday evening at approximately 7:40 p.m. when Officer Fisher, working Operation Pull Over DUI, noticed a vehicle traveling east on U.S. 30 at 66 mph in a 45 mph construction zone. Officer Fisher stopped the vehicle on U.S. 30 west of Plymouth Goshen Trail.
The driver was identified as Logan Hepler, 22, from Bourbon. The officer detected the odor of an alcoholic beverage coming from Hepler and noticed his eyes were glassy. Hepler admitted to the officer that he had one beer. A field sobriety test was conducted, and Hepler was given a portable breath test, which showed a result of .202. Hepler was then offered a certified test, and the results showed his blood alcohol content was .263 on a certified blood draw — more than three times the legal driving limit of .08 and well above the .15 threshold for enhanced penalties.
Hepler was arrested for OWI above .15 and OWI Endangerment and booked into the Marshall County Jail.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
