Officer-involved shooting with Winamac man deemed self-defense

Officials have determined police involved in a shooting of a Winamac man near Chesterton June 18, acted in self-defense.

Porter County Prosecutor Gary German stated on Monday, Aug. 11, the two officers involved in the a shoot out were not only protecting themselves, but also numerous members of the public. Joesph Gerber, 45 of Winamac was killed during the incident. At the time of the shooting Gerber had an active warrant for his arrest for allegedly violating the terms of his home detention.

"The active warrant for his arrest obviously explains why he chose to flee from the police. In summary, the actions of both Officer Mancera and Lieutenant Virijevich demonstrated their high level of training, professionalism and courage. I consider this investigation and case closed," German said.

According to court documents police were called to Hilton Garden Inn in Chesterton on June 18 on reports of an unwanted individual at the business with a firearm in his possession. Gerber was reported to have stayed at the hotel during the previous evening but had not been a registered guest.

When officers arrived on scene they reportedly attempted to use de-escalation techniques for several minutes with Gerber but were unsuccessful. While trying to flee the scene Gerber pulled out his firearm, shooting at police and striking an officer. Police returned fire, shooting Gerber several times. Gerber continued to fire his weapon at officers before he eventually turned the gun on himself.

An autopsy determined Gerber died of a self-inflicted gunshot wound. Toxicology reports also indicated the presence of a significant amount of methamphetamine in Gerber's system.
