A probable cause affidavit states the crime was first reported on August 27, after Rochester Police officer received information about a child who had been sexually abused. The alleged victim was scheduled for a forensic interview with the Department of Child Services September 1, after a school counselor reported the incident.

During the search Baugh lead officers to where he kept the items. Police also discovered a clear smoking device that contained burnt residue that later tested positive for methamphetamine during the search.
According to officers, Baugh claimed he had been clean from methamphetamine for approximately three months prior to the search.
Baugh was arrested on September 2, and is currently being held at the Fulton County Jail. A pretrial conference is schedule for Baugh in the Fulton County Circuit Court on September 28.
