Marshall County Commissioner raises concern on FLOCK Camera contract renewal

The automatic renewal clause in the Marshall County FLOCK camera contract drew scrutiny from the Marshall County Board of Commissioners Monday, after Commissioner Jesse Bohannon raised the issue during the board's regular meeting — despite it not appearing on the agenda.

FLOCK cameras are operated by the Marshall County Prosecutor's Office. Prosecutor Nelson Chipman confirmed to GIANT fm WTCA that the current contract is a three-year agreement at $2,500 per camera and includes an automatic renewal clause. The deadline to opt out of that automatic renewal is October 14th.

"With the ongoing discussion of FLOCK cameras, I know I'm out ahead of everybody else on this issue as far as my desire to take action," Bohannon said during the meeting. "I do know we don't have many county contracts that don't come up for annual review. This has been one of them."

Bohannon asked County Attorney Sean Surrisi whether he had reviewed the current contract with the vendor. Surrisi confirmed he had looked at it a few months ago when the discussion first began, and while he could not recall the specific terms, he remembered the contract contained an automatic renewal provision.

Commissioner Stan Klotz noted that he believed the contract is a three-year agreement set to expire in mid-2027. Commissioner Adam Faulstich added that he had obtained a copy of the contract from the Auditor's Office approximately two weeks ago, confirming that the automatic renewal clause is indeed included.

"At the very least, I would like to have a report back at our next meeting about the terms of the contract and the renewal," Bohannon said. "I think almost all of our other vendors — this ought to be a contract that we do an annual renewal on so we can get some oversight on it."

Bohannon made clear that he opposes including an automatic renewal clause in any future contract, stating that it should instead come up for annual review to allow proper oversight by the board.

The matter is expected to be revisited at the commissioners' next scheduled meeting, Monday, August 17th.
