Officers from the Plymouth Police Department were dispatched to the Arby's on North Oak Drive on Wednesday, October 8th, at 10:35 p.m. for a report of an intoxicated driver in the drive-through lane.
The driver of the vehicle was identified as 30-year-old Daniel K. Colburn of Plymouth. He was found to be operating the vehicle while intoxicated. He was arrested and transported to the Marshall County Jail.
While being transported to jail, Colburn slipped his handcuffs to the front of his body. Arriving at the jail, Colburn kicked the patrol vehicle door open when he was being extracted from the vehicle, causing it to hit an officer.
Daniel Colburn was charged with operating a vehicle while intoxicated as well as battery against a public safety official.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
