On Saturday night, August 31st at approximately 9:30 pm, the Marshall County Central Dispatch Center received a 911 call for an unknown accident, at U.S. 31 and Veterans Parkway.
Arriving on scene, Marshall County Police found a single vehicle accident. The vehicle left the roadway and impacted the cable barrier in the median.
During the accident investigation the driver, 32-year-old Tresh-Ilyn Alberto Withey was found to be intoxicated. After she was administered a certified test and found to have a BAC of .409, she was transported to the Marshall County Jail and booked in for operating a vehicle with a BAC at .15 or more and held on a $1,500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
