Plymouth woman arrested for attempting to pick-up children while under the influence of alcohol

On Sunday May 5th, at 7:23 p.m. Marshall County Deputies were dispatched to the 10,000 block of Tyler Road in Bremen for an unwanted guest.

The caller advised dispatch that the female smelled heavily of alcohol and was causing issues at the residence.

Marshall County Deputies arrived on scene and found 31-year-old Tresh I. Withey of Baker Street in Plymouth not only operated a vehicle while intoxicated attempting to pick up her children from the residence, but that she had also battered one of the household members.

Withey was taken to the Plymouth Hospital and once cleared, was transported to the Marshall County Jail where she was booked in for operating a vehicle while intoxicated with an alcohol concentration equivalent (ACE) of .15 or greater, a class A misdemeanor and domestic battery as a class A misdemeanor. Tresh Withey was held on a $1500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
