Plymouth teen charged in Rochester burglary

The suspect of a recent burglary in Rochester says he doesn't remember entering the apartment he is accused of damaging while under the influence of drugs and alcohol. 

Jacob L. Spencer, 18, of Plymouth, was arrested Tuesday on a warrant charging him with residential entry, a Level 6 felony, and criminal mischief, a Class A misdemeanor. The charges stem from a burglary incident at 426 Jefferson St., reported to Rochester Police Department during the early morning hours of Sept. 24.

A probable cause affidavit prepared by RPD Officer Catherine Diveley indicates that Elliot Corner returned home to find an unknown man, later identified as Spencer, slumped over on his couch and the apartment filled with smoke. 

With Spencer reportedly unconscious, Corner entered the home and found a pile of plastic storage containers inside his oven, which was on. He then retrieved his personal handgun and exited the apartment. 

Corner told police he had never seen Spencer before, and never gave him permission to be inside his apartment. 

Diveley was the first officer to arrive at the home. She noted Spencer did not respond to loud verbal commands and did not become responsive until administered Narcan upon the arrival of other officers and medics. 

Spencer was subsequently escorted out of the residence and transported to Woodlawn Hospital. Due to extended observation time, charging information was forwarded to the Fulton County Prosecutor's Office rather than taking him to jail then. A warrant was issued for his arrest on Oct. 1.

Diveley additionally reported that Spencer had cut Corner's smoke detector off the wall and stabbed it with a knife. He also is accused of damaging a TV beyond repair. 

According to the probable cause, Spencer admitted to consuming multiple fentanyl tablets and alcohol earlier in the evening. 

"Mr. Spencer advised he is addicted to pain medication and other illegal narcotics," Diveley stated. "Throughout conversation, Mr. Spencer advised he did not remember entering Mr. Corner's residence, and causing said destruction."
