On Tuesday, August 13th around 9:30 p.m. a deputy with the Marshall County Sheriff’s Department checked on a male with a motorcycle that was driving erratically. The driver of the motorcycle, 71-year-old Robert Erickson told the officer he had run out of fuel.
Deputy Geiger observed signs of impairment when speaking to Mr. Erickson. He also showed signs of impairment.
Tests were offered and taken by Mr. Erickson including a certified blood test that found he had a blood alcohol content of .154%. Mr. Erickson was then arrested for operating a vehicle while intoxicated and taken to the Marshall County Jail for processing. He was held on a $1,500 cash bond.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
