Officer Wozniak with the Marshall County Sheriff’s Department located a white 2016 Chrysler van parked in front of a business with the vehicle running and lights on in the 11000 block of 11th Road at 12:08 A.M. Tuesday, January 13th.
The officer found 25-year-old Fernando Rebollo-Diaz of 12B Road in Argos asleep behind the wheel of the running vehicle with an open alcoholic beverage container in the cup holder.
It took several attempts by the officer to get the driver’s attention, and once he spoke with a Rebollo-Diaz, he detected the strong odor of alcohol.
Field sobriety tests were completed, and a certified blood draw showed his blood alcohol to be over three times the legal limit of alcohol.
Rebollo-Diaz was charged with operating a vehicle while intoxicated with a prior conviction. He was transported to the Marshall County Jail and held on a $1,500 cash bond.
