Plymouth woman arrested Aug. 16th & 18th OWI and other charges

A 42-year-old Plymouth woman was arrested on Friday, August for public intoxication and operating while intoxicated.  She was released Sunday morning at about 8:15 with No Judicial Review and booked into the county jail again on Sunday at 8:30 p.m. 

On Sunday, August 18, at approximately 6:00 PM a Marshall County Sheriff’s Department K-9 Deputy responded to the report of a possibly impaired driver near Olive Trail and 13th Road. The deputy located the vehicle and conducted a traffic stop at Olive Trail and 14B Road. The driver was identified as 42-year-old Mary Balboa of Nursery Street in Plymouth.

During the traffic stop, K-9 Diesel conducted an open-air sniff around the vehicle and alerted to the presence of narcotic odors emitting from the vehicle. A search was conducted and suspected crack cocaine, synthetic drugs, and drug paraphernalia were located inside the vehicle.

Officer Bennett suspected that Balboa was operating the vehicle while intoxicated by a controlled substance.  She was transported to the Plymouth Hospital for a chemical test and then to the Marshall County Jail. Mary Balboa was booked for possession of cocaine or a narcotic drug less than 5 grams when an enhancing circumstance applies, operating a vehicle while intoxicated with a prior conviction, possession of a synthetic drug or look-alike substance, possession of paraphernalia, and operating a vehicle with a controlled substance in the body. She was held on a $1,505 bond.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
