Sunday morning, March 12th at 7:30 Officer Schieber with the Plymouth Police Department observed a vehicle traveling east in the westbound lane of US 30 from Oak Drive. A traffic stop was conducted and as a result of the investigation, two people were arrested.
The driver Trever Yoder, 20, of Nappanee was arrested for Neglect of a Dependent and Illegal Consumption of Alcohol.
An adult passenger in the vehicle was identified as Owen Borkholder, 19, of Nappanee. He was found to be intoxicated and arrested for Illegal Consumption of Alcohol.
Four juveniles were also in the vehicle and found to have been consuming alcohol. The juveniles were released to their parents and are pending juvenile charges once reviewed by the prosecutor’s office.
Both Trever Yoder and Owen Borkholder were transported to the Marshall County Jail. They were held until later on Sunday and were released after posting their cash bonds.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
