On Monday, members of the Board of Public Works and Safety affirmed a demolition order sent to Sheila Ellabarger for the property at 2220 Lake Avenue.
A registered letter sent on September 30th was accepted on October 2nd and states that the property at 2220 Lake Avenue is unsafe and must be demolished and removed. The property owner must begin substantial demolition within 30 days, and the entire home must be demolished and removed within 60 days.
Building Commissioner Dennis Manuwal Jr.'s letter cites Indiana Code 36-7-9-5(a)(7) and tells the property owner that the Board of Public Works and Safety would hear their evidence and arguments at its October 14th meeting. The property owner did not appear.
The letter also states that if they don’t comply with the demolition order, the City of Plymouth intends to take action to enforce the order by directing a contractor to demolish and remove the unsafe building at the owner’s cost and/or the City may seek enforcement of the order in Marshall Superior or Circuit Court. They would be responsible for all costs incurred, including court costs and a civil penalty not to exceed $5,000.
It was noted that the Building Commissioner has been working on the issues at this residence for several years.
