A report of an individual firing a handgun at 1002 West Monroe Street Monday morning at about 2:20 sent officers from the Plymouth Police Department to investigate.
Plymouth Police officers were dispatched to the W Monroe Street residence for a disturbance. They were told that a male inside the residence, Douglas R. Moya Diaz, 35, who has a Jackson Heights address in Plymouth had fired rounds from a handgun while inside the garage, pointed a loaded firearm at the homeowner, and fired more rounds outside the residence.
Plymouth Police located a firearm and spent casings at the scene.
Moya-Diaz was transported to the Plymouth Hospital for jail clearance and then to the Marshall County Jail. He was booked in on charges of felony intimidation, criminal recklessness with a deadly weapon, and pointing a loaded firearm.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
