Around 7:30 in the morning on Sunday, June 2nd, Officer Enyart with the Plymouth Police Department was alerted of a male, possibly intoxicated, trying to put fuel in a vehicle at 504 West Jefferson Street.
This intoxicated male reportedly smelled like alcohol and was seen staggering. The suspected male was identified as 45-year-old Gary Mauricio Cespedes of Knox.
During Officer Enyart’s investigation, it was found that Cespedes was intoxicated, blowing a .302 on a portable breath test. Besides the intoxication level, Cespedes did not have a driver’s license, and the Illinois vehicle registration in the vehicle was suspended. To make matters worse, the registration’s vehicle owner was not Cespedes. Seeing as though Cespedes was outside of the vehicle at the time of the investigation, and was not seen operating the vehicle, he was arrested for public intoxication.
The Knox man was brought to the Marshall County Jail once jail clearance was obtained from the hospital due to the levels of alcohol. Cespedes was booked at 9:14 AM. The vehicle was impounded, and he was issued a $255 cash bond and a court date set for July 2, 2024.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
