John "Brad" Weaver, 52, of Rochester, received a fully suspended sentence Tuesday for a drunk driving incident that occurred earlier this year in Warsaw.
An Indiana State Police lieutenant was sentenced Tuesday in Kosciusko County on a misdemeanor charge of driving while intoxicated.
John "Brad" Weaver, 52, of Rochester, pled guilty to operating a vehicle with an alcohol concentration equivalent to 0.15 or more, a Class A misdemeanor. He was sentenced by Kosciusko Superior Court II Judge Torrey Bauer to 365 days in jail, all of which was suspended.
As part of his sentence, Weaver received a 180-day license suspension. Specialized driving privileges were granted, along with the requirement of an ignition interlock device.
Weaver was arrested Aug. 6 after a report was made to the Kosciusko County Sheriff's Office about a man who appeared to be intoxicated and staggering around near the Moose Family Center Lodge in Warsaw.
When a deputy arrived on scene, he observed a vehicle backing out of the parking spot it had been in, exiting the parking lot. The deputy followed the vehicle, noticing it had been driven over the center line on Lake Street.
A probable cause affidavit states that the driver, later identified as Weaver, exited the vehicle when the deputy approached him, using the vehicle to balance while standing. Weaver claimed he had just came from a football referee meeting at Pizza King. The deputy noticed Weaver had bloodshot eyes, slurred speech and the smell of alcohol on his breath. When the deputy asked Weaver if he had been drinking, Weaver claimed that he had about four drinks.
Court documents state that Weaver agreed to perform field sobriety tests, but had failed several of the tests. A portable breath test taken by Weaver showed results of 0.19 BrAC, and his chemical breathalyzer results came back as 0.219g/210L.
