Deputy Bragg with the Marshall County Sheriff’s Department arrested two individuals last week for operating while intoxicated and endangering.
Last Wednesday, October 23rd the officer stopped 65-year-old Thomas C. Hall of Warsaw on U.S. 31 near 4A Road and determined that Hall was intoxicated. He was lodged in the Marshall County Jail on a $1,500 cash bond for operating while intoxicated endangering. Hall was released 48 hours later with no judicial review.
Officer Bragg also arrested a South Bend man on Sunday October 27, just before 2 A.M.
While on routine patrol on State Road 17 near Sycamore Road he located a vehicle on the north side of the intersection that appeared to have been involved in a collision. The driver of the vehicle involved was identified as 31-year-old Dakota S. Lamberson and the officer determined that he was intoxicated.
Lamberson was arrested and lodged in the Marshall County Jail for operating while intoxicated – endangering and operating while intoxicated with a BAC above 015%. He was held on a $1,500 cash bond that was paid just before 5 P.M. Sunday and released on bond.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
