Two men from out of state face drug and impaired driving charges following an early morning traffic stop on U.S. 30 that led to the discovery of suspected marijuana in their vehicle.
Patrolman Vinson with the Plymouth Police Department initiated a traffic stop at approximately 1 a.m. Friday, December 27, on U.S. 30 near Michigan Street, after observing a speeding violation.
During the stop, Vinson was assisted by his partner, K9 Castor, who alerted to the presence of illegal substances in the vehicle.
Following the K9 alert, officers located suspected marijuana inside the vehicle. During the investigation, the driver also showed signs of impairment.
Officers obtained a search warrant and executed a blood draw on the driver. Both occupants of the vehicle were then taken into custody.
The passenger, Oswaldo Navagomez, 26, of Garden Grove, California, was transported to the Marshall County Jail and booked on a preliminary charge of possession of marijuana.
The driver, Brandon Gutierrez-Luevano, 25, of Chicago, was also transported to the Marshall County Jail and booked on preliminary charges of possession of marijuana, operating while intoxicated—controlled substance, and operating while intoxicated—endangerment
The blood draw results will be analyzed by the Indiana State Police Laboratory. The cases will be reviewed by the Marshall County Prosecutor's Office for potential formal charging.
All suspects are presumed innocent until proven guilty in a court of law. Charges mentioned are allegations, and defendants have the right to legal representation and a trial.
