Plymouth man faces resisting arrest, suspended license charges after traffic stop

A routine traffic stop Thursday morning escalated when a Plymouth man allegedly fought with an officer while being taken into custody for a driving violation.

Officer Krynock with the Plymouth Police Department initiated a traffic stop for an infraction in the 200 block of Klinger Street at approximately 9:45 a.m. on March 5.

During the stop, the officer identified the driver as 33-year-old Javier De Jesus Aguilera, a resident of Klinger Street. A check of Aguilera's driving record revealed that his license was suspended, with a prior suspension conviction within the last 10 years.

According to police reports, as Officer Krynock attempted to take Aguilera into custody for the driving offense, the suspect physically resisted arrest.

Aguilera was ultimately detained and transported to the Marshall County Jail. He was booked on preliminary charges of driving while suspended with a prior conviction within 10 years and resisting law enforcement

Charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed. Aguilera is presumed innocent throughout the proceedings and is entitled to be represented by counsel and to a trial by jury, at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
