Plymouth man arrested for OWI after failing to dim headlights

A Plymouth man who had been drinking was arrested after he failed to dim his headlights just before 1 a.m. Sunday.

On September 14th, a Marshall County Deputy stopped a red Ford Mustang on Oak Road just south of Jefferson Street for failure to dim headlights. The driver of the vehicle, identified as 29-year-old Austen Hayes of Deer Trail in Plymouth, was found to have been drinking.

After field sobriety tests and a certified breath test, it was determined that Hayes was intoxicated.  He was arrested for operating a vehicle while intoxicated and booked into the Marshall County Jail at 1:32 a.m. Sunday.  At 1:18 p.m. Sunday, Hayes was released after posting a $1,500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
