On Saturday at approximately 1 a.m., Plymouth police officers were dispatched to the 700 block of North Center Street for the report of a physical altercation.
During the investigation, it was determined Dario Carvajal Santos, 30, of the 200 block of West Monroe Street in Plymouth, was determined to be the aggressor in a domestic battery in the presence of a child.
Carvajal Santos was lodged into Marshall County Jail for the charge of domestic battery-simple assault and domestic battery in the presence of a child less than 16 years old. He was released 24 hours later with No Judicial Review.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
