A Portage man is facing multiple charges after a 911 caller reported seeing him nearly fall out of his truck at a Plymouth gas station late Thursday night.
At just before midnight on July 9, Marshall County Central Dispatch received a 911 call from the BP Gas Station at 423 N. Michigan Street reporting a male who had almost fallen out of his vehicle at the fuel pumps. Plymouth Police responded and Officer Ayala located the vehicle and made contact with the driver, later identified as Donald Somers, 36, of Portage.
Officer Ayala initiated a DUI investigation and filed a probable cause affidavit search warrant, which was approved by the Honorable Judge Aldridge of Marshall County Superior Court II. Test results revealed Somers was operating at nearly four times the legal blood-alcohol limit.
Somers was transported to the Marshall County Jail and booked on charges of operating a motor vehicle while intoxicated with a prior conviction, operating with a BAC of 15% or higher, endangerment, resisting law enforcement, possession of marijuana, and possession of paraphernalia.

They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
