The Marshall County Regional Sewer District took its final steps toward dissolution Wednesday, completing necessary business in less than 30 minutes during what is expected to be its last official meeting.
The meeting, held January 29 in the Marshall County Building's meeting room, is available for viewing on the county's YouTube channel.
Vice President Jay Stone presided over the meeting with five of the district's seven members present, guiding the board through its final agenda items.
Brenda Myers presented the financial report, showing an ending balance of $2,010,613.60. The district paid claims totaling $95,519.90 and approved $33,316.85 in new claims on Wednesday.
Myers reported that the bank will prepare treasurer's checks totaling $1,901,473.46 to wire to Star Financial, leaving the Regional Sewer District with a final balance of zero.
District Attorney Chris Nusbaum provided a legal update, noting that Philadelphia Insurance is reimbursing the district for legal costs related to the lawsuit between Marshall County and Thomas McFadden. The funds are expected to be returned by February 17, and Nusbaum will disburse them to Marshall County before the end of February.
The board also rejected all easements that had been obtained for the sewer project in Public Service Area 1. While the easements had not been accepted or signed, the formal rejection was necessary to close out the project.
The Regional Sewer District authorized its legal counsel to share compiled district records with the county attorney, including plans, meeting minutes, financial documents, and materials provided by JPR.
In a critical final step, the district agreed to file a dismissal of its appeal to the Indiana Department of Environmental Management (IDEM). Once the court orders the dismissal, IDEM's original order will come back into effect, officially dissolving the district.
