61-year-old Jan Lemler who is listed as homeless on the Plymouth Police Report was arrested on Tuesday morning for battery of a police officer by bodily fluid and resisting law enforcement.
Plymouth Police Chief John Weir and Assistant Chief Emenhiser served Mr. Lemler with a “NO TRESPASS” order at 116 South Walnut Street, the Habitat ReStore at about 10:15 Tuesday morning after a criminal mischief case was received from the City of Plymouth.
The report states that Mr. Lemler became agitated with the "No Trespass" order and came toward Chief Weir. The chief told Lemler to step back and at that point, he placed the "No Trespass" order on Lemler’s belongings. Jan Lemler came toward the police chief and spit on him. At that point, Lemler was taken to the ground and the chief and assistant chief placed him into custody. Sergeant West made the scene and transported Jan Lemler to the Marshall County Jail where he was booked for battery by bodily fluid and resisting law enforcement.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
