Board of Public Works approves confidential settle with NIPSCO on Hoham Drive Reconstruction Project

On November 10th, the Plymouth Board of Public Works and Safety approved a confidential settlement agreement with NIPSCO for the delay on the Hoham Drive Reconstruction Project.

During the meeting, City Attorney Jeff Houin told board members the city negotiated with NIPSCO over the additional costs the city incurred for the Hoham Drive Project because of delays caused by NIPSCO or its contractors.   He also said that NIPSCO was informed that the confidential agreement would be approved during a public meeting and that once an agreement was signed, it would be part of the public record.  Houin said if a request was made for the information, the city would inform NIPSCO of the request before releasing the information. 

GIANT fm WTCA requested the information on November 10th and received a copy of the agreement on Friday, November 21st

The agreement states, “The Parties have negotiated this Agreement with their respective representatives and attorneys, and the Parties wish to fully and finally resolve, by compromise and settlement, any and all claims, disputes, and obligations, known or unknown, which the Parties may have in connection with the Project.”

The financial compensation agreed to by the City of Plymouth and NIPSCO was $105,072.11.
