A 23-year-old Lakeville man was arrested early Friday morning, August 2nd at the Red Rock Inn.
At about 2:20 a.m. Officer Wallace with the Plymouth Police Department was conducting a follow up investigation at the Red Rock Inn when he observed a male passed out at the wheel of a parked vehicle.
The officer checked on the male who was identified as Joseph Fansler, 23, of Lakeville. The officer also observed suspected narcotics and paraphernalia on Fansler's face and person. After Fansler was woken up he was found to be in possession of narcotics and legend drugs. He was taken into custody and transported to the hospital for jail clearance.
Once seen by medical staff, Fansler was lodged at the Marshall County Jail on pending criminal charges of possession of a narcotic drug, possession of a legend drug, maintaining a common nuisance, possession of paraphernalia, and public intoxication and held on a $1,500 cash bond.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
